Conditions of Sale
James Adam and Sons trading as Adam’s carries on business on the following terms and on such other terms as may be expressly agreed with the Auctioneer or set out in any relevant catalogue. By registering to bid, in person or online, you accept these conditions. The full conditions are available from our offices on request.
Auctioneer acting as agent
The Auctioneer is selling as agent for the seller unless it is specifically stated to the contrary, and reserves the right to bid on behalf of the seller. The Auctioneer may refuse any bid, advance the bidding in any manner it may decide, withdraw or divide any lot, combine lots and, in the case of a dispute, put any lot up for auction again.
Buyer’s premium & VAT
Buyer’s premium is 25% including VAT for Irish Art, Irish Old Masters, Fine Jewellery & Watches, Jewellery Box, Fine Watches, Mid-Century Modern and Wine & Spirits, and 30% including VAT for Fine & Decorative Arts auctions and all other lots included in online-only auctions. All lots are sold within the Auctioneer’s VAT margin scheme; Revenue regulations require the buyer’s premium to be invoiced at a rate inclusive of VAT, and this VAT is not recoverable by VAT-registered buyers.
Condition & descriptions
Ample opportunity is given for the inspection of lots before the auction. Statements in any catalogue as to attribution, authorship, genuineness, origin, date, age, provenance, condition or estimated selling price are statements of opinion only. All lots are sold with all faults and imperfections and errors of description.
Forgeries
Any amount paid by a buyer for a lot which is proved within 3 years of the auction to be a forgery shall be refunded, provided the lot is returned in the same condition as at the time of the auction, subject to the full conditions.
Payment
Invoices may be paid online, by bank transfer, by phone or in person. Non-EU card payments are subject to an additional 2% of the invoice total. The maximum cash accepted per transaction is €8,000, and cash payments over €500 require a PSRA cash origin form. Interest may be charged on late payments.
Collection & storage
Lots collected within 10 days of the sale incur no charge. From the 11th day an administration fee (€70 large objects / €35 small objects) and daily storage (€8 / €4 per lot) apply, all subject to VAT. Paid lots uncollected after 30 days may be re-offered in the buyer’s name; lots uncollected 90 days after a final notice may be deemed abandoned.

If dissatisfied, you may complain to the Property Services Regulatory Authority, Abbey Buildings, Abbey Road, Navan, Co. Meath, C15 K7PY. These conditions are governed by Irish law.
